Eligibility to obtain Legal Heir Certificate:
Following people are eligible to apply to obtain certificate:
- Spouse of the deceased person
- Son/Daughter or Children of the deceased person
- Mother or father of deceased person
- Siblings of the deceased person
Purpose of Legal Heir Certificate:
- To transfer the properties, dues and assets of deceased person to his/her legal heirs.
- To claim the insurance of the deceased person.
- To sanction and process the family pension of the deceased person/employee.
- To receive dues of the deceased person such as gratuity, provident fund etc from the concerned office or from the Government.
- If the deceased person has worked as state or central Government employee, then to receive salary arrears of the deceased person,
- To obtain employment of the deceased person based on compassionate appointments.

After the death of a person, it is very important to have a legal heir certificate to handover deceased movable and immovable property to his/her right successor so that he/she can own the property of the deceased person legally. A legal successor certificate is issued by the Tehsildar after conducting a proper investigation with the appropriate heirs under Department of Revenue in Tamil Nadu. Once the applicant receives the token number, Tehsildar issues the certificate within 16 days from the date of submission of the form.
